These Terms of Service ("Terms") govern your access to and use of the Market Makers website, member area, educational content, and related services (collectively, the "Service"). Please read them carefully. By creating an account or accessing the Service, you agree to be bound by these Terms.

Acceptance of terms

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

Market Makers reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Eligibility

To use the Service, you must: (a) be at least 18 years of age; (b) have the legal capacity to enter into a binding contract in your jurisdiction; and (c) not be a resident of, or accessing the Service from, a jurisdiction where its use would be restricted or prohibited.

The Service is not available to residents of the United States of America, the United Kingdom, or any other restricted jurisdiction. By using the Service, you represent and warrant that you meet these eligibility requirements. If you no longer meet them, you must stop using the Service immediately.

Description of service

Market Makers provides an educational platform focused on gold (XAU/USD) trading. The Service includes video courses, written materials, analytical tools, indicators, signals, live sessions, and a member community — all designed to improve your understanding of technical analysis and market structure.

In addition to educational content, Market Makers may introduce you to a partnered broker through which you can open a live trading account. This introduction is part of the Service, but trading on that account is entirely your own responsibility.

Introducing-broker and affiliate compensation disclosure

Market Makers operates as an introducing broker (IB) and may receive compensation from our partnered broker when accounts are opened or funded through our referral links, or based on trading activity generated through those accounts. This compensation is paid by the broker, not by you, and does not represent an additional charge on your trades or deposit.

You should be aware of this financial relationship. Our content and recommendations are subject to this conflict of interest, and you should seek independent advice where appropriate.

The 14-day free trial

New members receive a 14-day free trial with full access to the Service. No credit card or payment is required to start the trial. At the end of the trial period, access will pause unless you fund a partnered broker account as described below.

Membership and the $500 broker deposit

After the trial, ongoing membership is unlocked by funding a partnered broker account with a minimum of $500. This is a one-time condition for continued access — there is no subscription fee and no recurring payment to Market Makers.

The $500 is your own trading capital, deposited into your own account at the broker, held in your name. It is not a fee, a payment, or a transfer to Market Makers. Market Makers does not hold, receive, or have access to your deposited funds. You may trade with your deposit and may withdraw it in accordance with the broker's standard terms.

Market Makers reserves the right to change the membership conditions, including the minimum deposit amount or the partnered broker, at any time. Existing members will be given reasonable notice of material changes.

Not financial advice — no guarantee of results

All content provided through the Service — including courses, live sessions, signals, indicators, commentary, and community discussions — is strictly educational. Nothing provided by Market Makers constitutes financial advice, investment advice, trading advice, or a personal recommendation to buy or sell any financial instrument.

Market Makers makes no representation or warranty that any strategy, indicator, signal, or educational content will result in profits or avoid losses. Past results shown are illustrative only and are not indicative of future performance. You are solely responsible for your own trading decisions and their outcomes.

User obligations and acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: (a) use the Service in any way that violates applicable laws or regulations; (b) share your account credentials with any other person; (c) access or attempt to access areas of the Service you are not authorised to use; (d) interfere with or disrupt the integrity or performance of the Service; (e) engage in any conduct that is abusive, harassing, or harmful to other members or to Market Makers.

Intellectual property

All content provided through the Service — including video courses, written materials, indicators, tools, trading models, graphics, and branding — is the intellectual property of Market Makers or its licensors and is protected by applicable copyright, trademark, and other intellectual-property laws.

You are granted a limited, personal, non-transferable, non-exclusive licence to access and use the content for your own private, non-commercial educational purposes during your active membership. You must not copy, redistribute, sublicence, sell, publish, share, or otherwise make available any part of the Service content to any third party, whether for compensation or not, without the prior written consent of Market Makers.

Third-party links and services

The Service may contain links to third-party websites, including the partnered broker's platform. These links are provided for convenience only. Market Makers has no control over, and accepts no responsibility for, the content, accuracy, terms, or practices of any third-party site or service.

Your use of any third-party service — including the partnered broker — is governed by that third party's own terms and conditions. Market Makers is not a party to any agreement you enter into with a third party.

Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Market Makers disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Market Makers does not warrant that the Service will be available at all times, that errors will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, Market Makers and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost data, loss of goodwill, or trading losses — arising out of or in connection with your use of, or inability to use, the Service.

In no event shall the total aggregate liability of Market Makers to you for all claims arising out of or relating to the Service exceed the greater of (a) the amount you have paid to Market Makers in the twelve months preceding the claim, or (b) one hundred dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above may not apply to you in full.

Indemnification

You agree to indemnify, defend, and hold harmless Market Makers and its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Suspension and termination

Market Makers may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including, without limitation, breach of these Terms, failure to maintain an active funded broker account, or conduct that Market Makers considers harmful to other members or to the Service.

You may cancel your membership at any time by contacting us at support@marketmakersfx.net. Cancellation does not entitle you to any refund of broker deposits, as those funds are held at the broker and not by Market Makers.

Changes to the service and terms

Market Makers reserves the right to modify, suspend, or discontinue any part of the Service at any time. We will endeavour to provide reasonable notice of material changes.

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any update constitutes your acceptance of the revised Terms.

Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of [governing-law jurisdiction — confirm], without regard to its conflict-of-law provisions.

Any dispute arising out of or in connection with these Terms or the Service shall first be subject to good-faith negotiation between the parties.
